In the matter of Marketing Technology Solutions v. MediZine LLC, a trade secret and copyright infringement case involving alleged misappropriation of source code, DisputeSoft served as a software expert for the defendant, a health marketing company.

    Marketing Technology Solutions (MTS) filed suit against MediZine in the U.S. District Court for the Southern District of New York, alleging that MediZine used MTS’s copyrighted software for generating online sales leads. MTS requested both injunctive relief and monetary damages.

    DisputeSoft analyzed whether MTS’s software product could be deemed substantially similar to the software used by MediZine.

    DisputeSoft software copyright infringement expert Jeff Parmet authored an expert report detailing the results of this analysis and found that MediZine’s product was neither copied nor derived from MTS’s copyrighted software. The case was resolved when MediZine agreed to discontinue use of the allegedly infringing software.
