DisputeSoft was engaged post-litigation as a software copyright infringement expert by Paycom Payroll in the matter of Paycom Payroll LLC et al v. Richison et al. to confirm that defendant, a former employee of plaintiff, had adhered to a consent order by removing all infringing software from its competitive product.
DisputeSoft’s experts gathered software from the defendant and examined it for similarities with the plaintiff’s software. Software copyright infringement expert Nick Ferrara performed the preliminary steps of an abstraction filtration comparison (AFC) analysis, as ordered by the Court. As part of the AFC analysis, DisputeSoft examined the two software systems’ user interfaces, table schema, and source code, which was written in Visual FoxPro, to search for evidence of non-literal copyright infringement.
