DisputeSoft was engaged by a group of European insurers and re-insurers in September 2014 regarding a software failure dispute in connection with Publicis Groupe Holdings BV v. SAP France in the International Court of Arbitration. DisputeSoft reviewed documents, pleadings, deposition transcripts, and the reports of each party’s experts to reach conclusions regarding delay related to the completion of training courses, risk analysis, and system design documents. DisputeSoft’s J. Todd Trivett co-authored an Advisory to Counsel.
DisputeSoft was engaged by the software surety Insurance Company of Southern Pennsylvania, a division of AIG, in the matter of Electronic Transaction Consultants Corporation vs. Miami-Dade County Expressway Authority in the Circuit Court of the Eleventh Judicial Circuit in and for Miami-Dade County, Florida, Case No. 12-46272CA10. DisputeSoft analyzed project documentation, interviewed fact witnesses from both parties, and applied applicable industry standards to investigate the factual basis, materiality, and strength of each side’s claims and defenses.
DisputeSoft was engaged by surety OneBeacon Technology in a project delay matter related to a data breach. OneBeacon was responsible for underwriting the performance bond for the implementation of its vendor’s software projects. Project delay and trade secret misappropriation expert Todd Trivett evaluated the reasonableness of the claims submitted with regard to the aborted, then re-started HCM implementation project.
