Publicis Groupe Holdings BV v. SAP France

DisputeSoft was engaged by a group of European insurers and re-insurers in September 2014 regarding a software failure dispute in connection with Publicis Groupe Holdings BV v. SAP France in the International Court of Arbitration.

Publicis had employed SAP to implement an ERP software system, but the project experienced significant delays. The insurers and re-insurers underwriting the surety bond on the contract between the two companies retained DisputeSoft to assist in determining whether the settlement between Publicis and SAP was reasonable based on the amount of schedule delay for which each party was responsible.

DisputeSoft reviewed documents, pleadings, deposition transcripts, and the reports of each party’s experts to reach conclusions regarding delay related to the completion of training courses, risk analysis, and system design documents.
