Court of Appeals for the Federal Circuit Upholds Invalidation of BSG Tech Patents

    The Court of Appeals for the Federal Circuit upheld a Texas District Court’s ruling invalidating plaintiff BSG Tech LLC’s database patents in the software patent infringement case BSG Tech LLC v. BuySeasons, Inc.

    The Court of Appeals agreed with the District Court’s evaluation that BSG Tech’s patents were “abstract ideas lacking any inventive step” and thus ineligible for patent protection according to the standard set forth by the Alice/Mayo framework.
