Summary Judgment Against Intellectual Ventures Vacated in Patent Infringement Case

    On September 4th, 2018, the Court of Appeals for the Federal Circuit (CAFC) vacated the decision of the U.S. District Court for the District of Delaware to grant summary judgment to defendant T-Mobile in the matter of Intellectual Ventures LLC v. T-Mobile USA, Inc.

    CAFC found that the District Court erred in its claim construction, which led to the finding of non-infringement. The software patent infringement case began in 2013, when Intellectual Ventures accused T-Mobile of infringing on a patent related to a media access control layer designed to ensure quality of service for software applications.
