On March 16, 2020, a judge in the U.S. District Court for the Eastern District of New York granted summary judgment to GEICO on one count of breach of a non-disclosure agreement, one count of trade secret misappropriation, and one count of conversion in the matter of Capricorn Management Systems, Inc. v. Government Employees Insurance Co.
In addition to finding that Capricorn failed to identify specific trade secrets related to the company’s automobile medical bill review software, Supercede, the judge determined that the software was not afforded trade secret protection after Capricorn filed the source code with the U.S. Copyright Office in unredacted form.
