DisputeSoft was engaged by Waste Management, Inc. in the matter of Waste Management, Inc. v. SAP®.
Waste Management alleged fraud, misrepresentation, and breach of contract by SAP®, a major vendor of enterprise resource planning (ERP) software.
In 2005, Waste Management entered into a contract with SAP® to license SAP®’s “Waste & Recycling” software product. According to Waste Management’s complaint, SAP® represented that its product was an “out-of-the-box” solution that required minimal customization. Waste Management alleged that the product as delivered was not capable of supporting Waste Management’s stated requirements without substantial modifications, and that they had been deceived by a “fake” product demonstration.
DisputeSoft analyzed documents and deposition testimony related to Waste Management’s claims of fraudulent misrepresentation and breach of contract.
